General Terms

§1 Contracting Parties, Conclusion of Contract, Inclusion of the General Terms and Conditions

1. The contract comes into force between you and Armin Heining, GAY-TANTRA® International, Elberfelder Straße 37, 10555 Berlin, VAT Nr. DE256243196. Goods will be shipped from the address mentioned above. 2. The contract is concluded by your offer (“Buy Now”) and acceptance by GAY-TANTRA®. 3. Offer: By clicking the button “Buy Now” on the page “Shopping Cart” of the shop your offer will be transmitted to the e-payment of GAY-TANTRA®. 4. Acceptance: The acceptance by GAY-TANTRA® takes place either by delivery of the goods, provision of the download product or confirmation via email, if the goods cannot be delivered right away. A confirmation via email can only take place if you stated your email address on the order. 5. If the goods or the downloads are not available, no contract is concluded. In this case we will inform you immediately and payments already made will be refunded. 6. Specially denoted products* and downloads require proof of age through an official document. Please scan and send such proof by e-mail to info@gay-tantra.eu or by photocopy / fax to GAY-TANTRA®, fax number: + 49 30 33023679. 7. These General Terms and Conditions will be part of each contract, in so far as no deviating agreements exist.

§2 Prices

1. Our prices are final prices and include legal value added tax (special rates for countries outside the EU). 2. The total price is made up of the prices of the goods you chose and the delivery costs. Please pay attention to §6 of these General Terms and Conditions regarding delivery costs and §4 (5) regarding return debit note.

§3 Right of cancellation and withdrawal

1. As a customer you have the right to annul the contract without stating reasons within 14 days after concluding the formal contract. The timely dispatch of the cancellation is sufficient to observe the deadline. Cancellation does not have to be effected in any particular way and can also be effected by sending back the goods together with the bill. The goods have to be in flawless condition. The goods must be packed properly and have to be complete and unused. 2. The right of cancellation does not apply to the delivery of audio and video recordings (CDs, DVDs, Bluray) if their seal has been broken by you. 3. The cancellation must be submitted to Armin Heining, GAY-TANTRA® International, Elberfelder Straße 37, 10555 Berlin, but can also take place via phone under the number +49 30 26344515, if you wish. 4. In the event of cancellation we ask you to send the goods back to Armin Heining, GAY-TANTRA® International, Elberfelder Straße 37, 10555 Berlin, carriage paid. Please state your bank account to ensure quick repayment. 5. Return expenses are to be paid by you for order values less than 40 EUR, unless the goods delivered do not correspond with the ones you ordered. If the order value exceeds 40 EUR, GAY-TANTRA® will pay the costs for return. The return will take place at the risk of GAY-TANTRA®. Please do not return the goods carriage forward, because they incur higher postal charges and will not be accepted by us. 6. In the case of a download product, the user agrees to have downloaded this product within 14 days, before expiry of the cancellation period. The right of cancellation is extinguished once the download has commenced. 7. Domestic place of general jurisdiction: Berlin / Germany

§4 Shipping of the Goods, Conclusion of the Contract, Payment

1. Download products are immediately available to you when payment has been effected. 2. The physical goods will be delivered within 2-14 workdays, if they are on stock. Should you need the goods by a certain date, please state this when ordering. 3. Should individual goods not be in stock, the available goods will be delivered first. Subsequent delivery will take place when the goods become available. We will pay delivery charges for subsequent delivery. 4. Regarding payment, several possibilities are possible depending on the country of delivery. 5. In the case of direct debiting, the user is liable for any costs arising from incorrect payment details.

§5 Data privacy

1. The data you state will not be disclosed to third parties unless it is urgently necessary for the processing of the order. 2. “Urgently necessary” means, for example, to forward your address to a transport company for the purpose of parcel shipment or to forward your account details to our bank. 3. Your personal data will be used exclusively for processing the order and not for any other purpose.

§6 Shipping costs

1. Digital products (E-books, MP3-, .zip-Downloads, …) are exempt from delivery costs. 2. Shipping costs National/Germany up to an order value of 100 EUR, amount to 4.50 EUR lump sum. Shipping is free for higher order values. 3. Shipping costs International/Europe up to an order value of 100 EUR, amount to 10 EUR lump sum, with a higher order value 12.50 EUR. 4. Shipping costs International/World up to an order value of 100 EUR, amount to 15 EUR lump sum, with a higher order value 28 EUR.

§7 Licences for downloads

The customer can purchase licences for downloads against or without payment and download them onto end devices of his choice, e.g. eReader, smartphone. The customer requires certain system prerequisites and reproduction software, e.g. eReader in order to use them. Any applicable connection costs are to be paid separately by the customer to his service provider.

§8 Copyright in the case of downloads

Downloads are protected by copyright. GAY-TANTRA® does not transfer ownership to the customer in the case of downloads. The customer receives the simple non-transferable right to use the titles offered solely for his personal use and in the form offered in compliance with copyright law. 2. The customer is permitted to make one-off downloads and solely for his personal use to copy such downloads onto the end devices in his ownership. Furthermore it is not permitted to alter downloads in any way in terms of contents or editing or to use altered versions, copy them for third parties, make them publicly accessible or forward them, put them on the internet or any other network for a fee or free of charge, imitate them, print them out, resell or use them for commercial purposes. 3. As far as possible GAY-TANTRA®, Armin Heining will make further downloads possible for the customer after the first download has been fully completed (re-downloads); however the customer has no entitlement in this respect. GAY-TANTRA®, Armin Heining is entitled at any time to alter temporarily or permanently the download option, or to suspend or terminate it. 4. Downloads can be individually digitally watermarked to allow the original purchaser to be traced and prosecuted in the event of wrongful use. Downloads can also be protected against illegal reproduction by means of DRM protection (Adobe Digital Rights Management). The use of these downloads by means of end devices of the customer is solely possible by means of the specific integrated Adobe-ID of the customer which is linked to the end device/devices of the customer.

§9 Reservation of proprietary rights

1. The goods remain our property until full payment.

§10 Warranty

1. Statutory warranty is valid for two years. The statutory warranty starts with the purchase date (purchase date = delivery of the goods).

§11 Other

1. The contract is subject to German law. Should one clause of the contract be or become void or should there be a loophole in the contract, this shall not affect the other clauses. Should you have questions or special wishes do not hesitate to call us. In personal contact most issues can usually still be solved easily.
